Terms of Service
The agreement between you and Nourity
Nourity is a personal wellbeing journal, not a medical app or device. It doesn't diagnose, treat or give medical advice. Nutrition values are AI estimates. If you have a health condition or a difficult relationship with food, please talk to a qualified professional.
Who we are and these terms
Nourity is provided by [Company legal name] ("Nourity", "we", "us"), a company registered in [Country of registration] with company number [Company number], registered address [Registered address]. Contact: hello@nourity.app.
These terms apply when you create an account or use Nourity. Please read them with our Privacy Policy, Consumer Health Data Privacy Policy and Cookie Notice, which explain how we handle your data. Agreeing to these terms is separate from giving consent to us processing your health data.
Who can use Nourity
- You must be 18 or older. You confirm this when you sign up. We'll close accounts we believe belong to someone under 18.
- Nourity is for personal, non-commercial use.
- Give us accurate details and keep access to your email account secure, because we sign you in with one-time codes sent there. Tell us straight away if you think someone else has accessed your account. You can end all sessions with Settings → Sign out on every device.
- One account per person. Don't share your account.
Not medical advice
Nourity is a personal wellbeing journal, not a medical app or device. It doesn't diagnose, treat or give medical advice. Nutrition values are AI estimates. If you have a health condition or a difficult relationship with food, please talk to a qualified professional.
Don't use Nourity to manage allergies, diabetes, eating disorders or any other condition that needs precise information or clinical care. If you are in crisis or worried about your health, contact a doctor or your local emergency services.
AI estimates may be wrong
Nutrition values and meal ideas are generated automatically by an AI model from the text you type. They are approximate, can be inaccurate or incomplete, and depend on how you describe your meal. The patterns Nourity shows are based only on your own entries. They don't show that one thing causes another, and they aren't scientific or medical findings. Use your own judgment.
Acceptable use
You agree not to:
- use Nourity for anything unlawful, harmful or fraudulent;
- try to access other people's accounts or data, or get around our security;
- scrape, overload or disrupt the service, or use bots or automated tools without our permission;
- reverse engineer, copy or resell the service, except where the law allows;
- enter content meant to manipulate or misuse our AI features, or other people's personal data;
- upload malware or anything that infringes someone else's rights.
Your content
Your journal belongs to you. You give us permission to store, process and display it only so we can provide Nourity to you, as described in our Privacy Policy. You can export it at any time from Settings → Your data.
The Nourity name, logo, design, software and meal library belong to us or our licensors. These terms don't give you any rights to them beyond using the app.
Free plan and Premium
Nourity has a free plan and a paid Premium plan. Prices are in US dollars and may include or exclude sales tax or VAT depending on where you live; checkout shows the final amount before you pay.
- Premium Monthly: $6.99 per month.
- Premium Yearly: $39.99 per year, with a 7-day free trial.
- Founding Lifetime: $89.99 one-off payment for Premium for as long as Nourity operates. Limited to the first 300 buyers.
Payments are processed by Stripe. We never see your card details.
Renewals and the free trial
- Monthly and yearly plans renew automatically at the end of each period, at the price shown at checkout, until you cancel.
- If you start the yearly free trial, you won't be charged during the 7 days. We'll email you a reminder before the trial ends and before you're charged. If you don't cancel before the trial ends, your yearly subscription starts and you're charged $39.99.
- We'll remind you before each yearly renewal.
- If we change the price of your plan, we'll tell you in advance. The new price applies only from your next renewal, and you can cancel before then.
Cancelling
You can cancel at any time online, in a few clicks, through Settings → Plan → Manage subscription, which opens Stripe's customer portal. Cancelling stops future renewals. You keep Premium until the end of the period you've paid for. Deleting your account also cancels any active subscription.
Lifetime
"Lifetime" means for as long as we run Nourity, not your lifetime. If we close the service, we'll give you at least [Notice period] notice and let you export your data. [Owner decision: whether to offer a partial refund if the service closes within a set period after purchase.]
Your right to cancel and refunds
If you're a consumer in the UK or the EU, the law usually gives you 14 days from the day you buy to cancel a digital purchase without giving a reason (the "cooling-off period").
- Free trial: you pay nothing during the trial and can cancel at any point in it.
- Starting Premium straight away: Premium unlocks immediately. At checkout we ask you to agree that it starts during the cooling-off period and to acknowledge what that means for your right to cancel. Depending on how the law classifies Premium, that means either you lose the right to cancel once Premium starts, or, if you cancel within 14 days, you get a refund minus a fair amount for the time you used.
- How to cancel in the cooling-off period: use the withdrawal option in Settings, or email hello@nourity.app with "Cancel my purchase". We'll confirm by email and refund to your original payment method within 14 days.
[Owner decision: refund policy specifics. For example: whether to offer a no-questions 14-day refund on every plan worldwide, whether to treat Premium as a service (pro-rata refund) or digital content (waiver), how Founding Lifetime refunds work, and whether any refunds are given after 14 days. Needs lawyer sign-off and must match the checkout wording.]
Nothing in these terms affects your legal rights if Premium is faulty or not as described.
Changes to Nourity
We keep improving Nourity and may change, add or remove features. If a change significantly reduces what you've paid for, we'll tell you in advance, and you may cancel and get a pro-rata refund for any unused paid period.
Ending your account
You can delete your account at any time in Settings → Delete account. This deletes your account and all entries straight away (encrypted backups are overwritten within 14 days) and cancels any subscription.
We may suspend or close your account if you seriously or repeatedly break these terms, if we must by law, or if we stop offering Nourity. Where reasonable, we'll warn you first and give you a chance to export your data. If we close your account without good reason, or because we're shutting the service down, we'll refund any unused paid period.
Our responsibility to you
We provide Nourity with reasonable care and skill, but we can't promise it will always be available or error-free, or that AI estimates will be accurate.
We're responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care. We're not responsible for loss that wasn't foreseeable, for business losses (Nourity is for personal use), or for decisions you make based on AI estimates or patterns, which are for general information only.
Except for the liabilities listed in the next paragraph, our total liability to you is limited to the greater of the amount you paid us in the 12 months before the claim or $100.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that can't be limited by law. Nothing affects your statutory rights as a consumer, including under the UK Consumer Rights Act 2015 or the consumer laws of the country where you live.
If you live in a US state that doesn't allow some of these limits, they apply only as far as that state's law allows.
Complaints and disputes
If something goes wrong, please email hello@nourity.app first. Most issues can be sorted out quickly.
These terms are governed by the law of [England and Wales], and the courts of [England and Wales] have jurisdiction. If you're a consumer living elsewhere, you also keep the protection of the mandatory laws of the country where you live and can bring a claim in your local courts.
Changes to these terms
We may update these terms, for example to reflect new features or changes in the law. We'll show the date at the top. If a change is significant, we'll email you at least [Notice period for terms changes] before it takes effect. If you don't agree, you can cancel and delete your account before the change applies. Changes won't apply to any period you've already paid for, unless the law requires it.
Other legal points
- If a court finds part of these terms unenforceable, the rest stays in effect.
- If we don't enforce a term straight away, we can still enforce it later.
- We may transfer this agreement to someone who takes over Nourity, and we'll tell you if we do. Your rights won't be reduced.
- No one else has rights under these terms.
